Abstract

PEMBUKTIAN TINDAK PIDANA GRATIFIKASI SECARA BERSAMA-SAMA DALAM PERKARA KORUPSI NAPOLEON BONAPARTE (Studi Putusan Nomor 46/Pid.Sus-TPK/2021/PN Jkt.Pst) Oleh: Deandra Rachma Azahra E1A017097 ABSTRAK Tindak pidana korupsi merupakan kejahatan yang memberikan dampak luar biasa, baik dari struktur, sosial, politik, ekonomi bahkan kejahatan nasional dan memerlukan penanganan khusus, kejahatan ini disebut sebagai kejahatan kerah putih, karena sulit dibuktikan. Salah satu tindak pidana korupsi yaitu, tentang gratifikasi. Seperti yang termuat dalam Putusan Nomor 46/Pid.Sus-TPK/2021/PN Jkt.Pst dimana Irjen Napoleon Bonaparte selaku Anggota Polri terbukti melakukan penerimaan sejumlah uang (gratifikasi) untuk melakukan suatu perbuatan yang bertentangan dengan tugas dan kewajibannya. Penelitian ini bertujuan mengetahui bagaimana pembuktian dan pertimbangan hakim dalam tindak pidana korupsi gratifikasi tersebut. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Sumber data yang digunakan adalah bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Metode pengumpulan data dilakukan dengan studi kepustakaan, data yang diperoleh disajikan dengan teks deskriptif sistematis, dan metode analisis data yang digunakan adalah metode normatif kualitatif. Berdasarkan hasil penelitian, Irjen Napoleon Bonaparte sebagai Anggota Polri dinyatakan telah terbukti secara sah dan meyakinkan secara bersama-sama melakukan perbuatan yang dilarang bagi Pegawai Negeri dalam Pasal 5 ayat (2) jo. Pasal 5 ayat (1) huruf a Undang-Undang Nomor 20 Tahun 2001 Tentang Perubahan atas Undang-Undang Nomor 31 Tahun 1999 Tentang Pemberantasan Tindak Pidana Korupsi jo. Pasal 55 KUHP. Irjen Napoleon Bonaparte dikenai sanksi dijatuhi pidana penjara selama 4 (empat) tahun dan denda sebesar Rp100.000.000,00 (seratus juta rupiah). One of the criminal acts of corruption is, about gratification. As contained in Decree No. 46 / Pid.Sus-TPK / 2021 / PN Jkt.Pst where Irjen Pol. Napoleon Bonaparte as a Member of the Police proved to receive a certain amount of money (gratuities) to do an act that is contrary to his duties and obligations. This research aims to find out how the evidence and consideration of judges in the crime of corruption gratification.The methods used in this research are normative juridical with descriptive analytical research specifications. The data sources used are primary legal materials, secondary legal materials and tertiary legal materials. Data collection methods are carried out with literature studies, the data obtained is presented with systematic descriptive text, and the data analysis method used is a qualitative normative method. Based on the results of the research, Irjen Napoleon Bonaparte as a Member of the Police was declared to have been proven legitimately and convincingly to jointly commit acts prohibited for civil servants in Article 5 paragraph (2) jo. Article 5 paragraph (1) letter a Law No. 20 of 2001 concerning Changes to Law No. 31 of 1999 concerning the Eradication of Criminal Acts of Corruption jo. Article 55 of the Criminal Code. Irjen Napoleon Bonaparte was sentenced to prison for 4 (four) years and a fine of Rp100,000,000.00 (one hundred million rupiah). Keywords: Proof, Gratification, Together
