Abstract

The responsibility of the airline company is the obligation of the air transport company to provide compensation experienced by passengers from flight delays or cancellations. In this case, H. Mikraj Sedekti Embau, S.H., MH., CIL., as a user of air transportation services felt aggrieved by the cancellation of the flight on the day of his departure without telling a clear reason. The Panel of Judges reaffirmed the decision of the Pontianak District Court which stated that the plaintiff's lawsuit was inadmissible because the plaintiff's lawsuit letter contained a juridical defformalrmil. The purpose of this study is to find out how legal protection of air freight service users in the case of flight cancellations based on Law Number 8 of 1999 concerning Consumer Protection. This study uses a normative juridical approach with descriptive analytical research specifications. The data source used is secondary data. The data collection method was carried out by literature study, the data obtained were presented with narrative text, and the data analysis method used was a qualitative normative method. Based on the results of research and discussions that have been carried out, it can be concluded that H. Mikraj Sedekti Embau, S.H., MH., CIL., as a consumer of air transportation service users has not received legal protection in the event of flight cancellations by pt. Lion Mentari Airlines is considered to have committed an act against the law because as a business actor has violated the rights of others and has not fulfilled the legal protection of the judge's ruling which is unacceptable because it has a juridical defect formal.
