Abstract

Law No. 8 of 1999 concerning Consumer Protection is expected to support the achievement of rights protection for consumers. Air freight services as one of the most effective transportation services in its operations have a standard. In this case Dwi Aryani as a passenger with a disability felt treated discriminatory and violated his rights because he was taken off the plane even though people with disabilities were also consumers, needing accessibility to meet the needs of both material and non-material needs. The purpose of this study is to find out how legal protection against persons with disabilities as consumers of aviation services in the event of discrimination by Etihad Airways airlines based on Law No. 8 of 1999 concerning Consumer Protection. This research uses normative juridical approach methods with analytical descriptive research specifications. The data source used is secondary data. The method of data collection is carried out by literature studies, the data obtained is presented with narrative text, and the data analysis method used is a qualitative normative method. Based on the results of research and discussions that have been conducted, it can be concluded that Dwi Aryani as a Consumer with a disability gets Legal Protection in the event of discrimination by airlines that are proven to have violated the provisions stipulated in Article 4 Letter (g), Article 7 Letter (c), Law No. 8 of 1999 concerning Consumer Protection and Article 5 letter (v) of Law No. 8 of 2016 concerning Persons with Disabilities, As well as committing unlawful acts that resulted in business actors being obliged to pay material damages of Rp.37,500,000.00 (Thirty-seven million five hundred rupiah) and Immateriil damages of Rp.500,000,000.00 (five hundred million rupiah) as well as an apology through print media to Dwi Aryani.
