Abstract
Based on UNCLOS 1982, archipelagic states can determine the right of passage for foreign ships through archipelagic sea lane passage. Sometimes in carrying out the right of passage violation occurs. In 2021 there was a violation of the right of archipelagic sea lane passage by the MT. Horse tanker ship with Iranian flag and MT. Freya tanker ship with the flag of Panama. The two ships stopped outside IASLs I to transfer fuel by turning off the Automatic Identification System. At the time of loading goods, the ship MT. Freya dumps waste into the sea which pollutes the marine environment. The purpose of this study is to find out the regulation of passage right of foreign ships in IASLs according to international law and Indonesian national law and to find out the settlement of the case on the violation of passage rights by the MT. Horse and MT. Freya ships in Indonesia’s Archipelagic Sea Lane passage. This research is a normative legal research, the data source used is secondary data. The data collection method is literature study and document study, the data obtained is descriptive methods and the data analysis method used is qualitative legal. Based on the research results, the provisions regarding the right of archipelagic sea lane passage is regulated in Article 53 of UNCLOS 1982. As an implementation of this article, the Indonesian government has issued Law Number 6 of 1996 concerning Indonesian Waters and Government Regulation Number 37 of 2002 concerning the Rights and Obligations of Foreign Ships and Aircraft in exercising the Right of Archipelagic Sea Lane Passage. In the case of IASLs violation by MT. Freya and MT. Horse, the Batam District Court decided that the two ship captains violated Article 317 jo Article 193 paragraph 1 of Law Number 17 of 2008 concerning Shipping. The captain of MT. Freya also violated Article 104 of Law Number 32 of 2009 concerning Environmental Protection and Management.
