Abstract

This study aims to examine the synchronization of regulations and the forms of a doctor’s legal responsibility for providing informed consent to patient with mental disabilities in receiving health services. The study adopts a statutory approach, focusing on inventorying statutory regulations (positive law), analyzing the level of legal synchronization, and discovering in concreto legal solutions. The data used in this research are secondary data collected through literature review. The data analysis method applies normative qualitative techniques with content analysis.The research findings indicate that the legal responsibility of doctors in providing informed consent to patients with mental disabilities in hospitals demonstrates vertical and horizontal synchronization. This means that lower-level regulations are based on higher-level regulations, and these regulations do not conflict with one another. The legal responsibility of doctors in providing informed consent to patients with mental disabilities within Indonesia's legislative structure includes civil legal responsibility as stipulated in Article 308 paragraph (2) of Law Number 17 of 2023 on Health and administrative legal responsibility as stipulated in Articles 304 paragraphs (1), (2), and (3) and Article 306 of Law Number 17 of 2023 on Health, Article 736 of Government Regulation Number 28 of 2024 on the Implementation of Law Number 17 of 2023 on Health, and Article 19 of the Regulation of the Minister of Health of the Republic of Indonesia Number 290/MENKES/PER/III/2008 concerning Approval of Medical Actions.
