Abstract

ABSTRAK Perlindungan hukum terhadap korban kecelakaan di tempat wisata merupakan aspek penting dalam menjamin hak-hak wisatawan sebagai konsumen atas rasa aman, keadilan, dan kepastian hukum. Dalam praktiknya, wisatawan rentan mengalami kecelakaan akibat kelalaian pengelola, minimnya informasi risiko, serta lemahnya pengawasan terhadap standar keselamatan. Namun, regulasi kepariwisataan di Indonesia belum secara komprehensif mengatur mekanisme pemulihan hak korban, terutama terkait ganti rugi dan restitusi. Penelitian ini berfokus pada bentuk perlindungan hukum kepada korban wisatawan pada peristiwa kecelakaan di wisata jembatan kaca The Geong, serta bagaimana hambatan terhadap perlindungan korban tersebut. Hasil penelitian menunjukan bahwa perlindungan korban yang diberikan berbentuk represif, yaitu pemberian ganti kerugian biaya pengobatan kepada korban yang mengalami luka-luka serta pelaksanaan putusan pengadilan oleh Tergugat pada perkara gugatan ganti kerugian yang diajukan oleh keluarga korban yang meninggal dunia. Adapun hambatan yang dialami dalam pemberian perlindungan hukum terhadap korban wisatawan berupa hambatan substansi yang disebabkan ketiadaan aturan yang mencantumkan perlindungan terhadap wisatawan, hambatan struktur yang disebabkan karena tidak adanya pengawasan yang ketat dari tempat wisata, serta hambatan kultural yang disebabkan oleh kurangnya kesadaran dari pengelola terhadap keselamatan wisatawan sekaligus kesadaran dari wisatawan atas keselamatannya sendiri. Kata Kunci: Perlindungan hukum, korban kecelakaan wisata, jembatan kaca, restitusi, kepariwisataan ABSTRACT Legal protection for victims of accidents in tourist attractions is an important aspect in guaranteeing the rights of tourists as consumers to a sense of security, justice, and legal certainty. In practice, tourists are vulnerable to accidents due to the negligence of managers, lack of risk information, and weak supervision of safety standards. However, tourism regulations in Indonesia have not comprehensively regulated the mechanism for restoring victims' rights, especially regarding compensation and restitution. This research focuses on the form of legal protection to tourist victims in the event of an accident at The Geong glass bridge tour, as well as how the obstacles to victim protection. The results showed that the victim protection provided was in the form of repression, namely the provision of compensation for medical expenses to victims who were injured and the implementation of court decisions by the Defendant in the case of compensation claims filed by the families of victims who died. The obstacles experienced in providing legal protection to tourist victims are in the form of substantial obstacles caused by the absence of rules that include protection of tourists, structural obstacles caused by the absence of strict supervision of tourist attractions, and cultural obstacles caused by the lack of awareness of managers of tourist safety as well as awareness of tourists for their own safety.
