Abstract

Abstract: Indonesia and the Philippines are two archipelago countries that have direct borders in the Southeast Asian region. The border which becomes the direct point of the two countries is the Sulawesi Sea from the Indonesian side and the Sulu Sea from the Philippine side. These two seas are a source of potential for fisheries and marine cultivation, as well as areas that are very vulnerable to transnational crimes such as terrorism, drugs, human smuggling and fishing. Especially in the fishing theft sector or illegal fishing, it is the main factor in the discussion in this thesis. The cooperation between Indonesia and the Philippines on this matter has actually been going on for a long time, however, illegal fishing by Filipino fishermen continues to occur in the Sulawesi sea. There are several factors that keep this happening, first, the factor of weak supervision carried out by the Indonesian apparatus and the increasing demand for fish supply in the Philippines due to the increasing culture of eating fish or what is often referred to as over fishing. Nevertheless, Indonesia and the Philippines continue to cooperate in law enforcement and eradicating transnationalism crimes in the Sulawesi and Sulu seas. Abstrak: Indonesia dan Filipina merupakan dua negara kepulauan yang berbatasan langsung di wilayah Asia Tenggara. Perbatasan yang menjadi titik langsung kedua negara adalah Laut Sulawesi dari sisi Indonesia dan Laut Sulu dari sisi Filipina. Wilayah kedua laut ini merupakan sumber potensi perikanan dan budidaya kelautan, sekaligus wilayah yang sangat rentan akan terjadinya kejahatan transnasional seperti, terorisme, narkoba, penyeludupan manusia, dan pencurian ikan. Khusus pada sektor pencurian ikan atau illegal fishing menjadi faktor utama pembahasan pada skripsi ini. Kerja sama antara Indonesia dan Filipina mengenai hal tersebut sebenarnya telah berlangsung lama, tetapi, pencurian ikan yang dilakukan oleh nelayan Filipina terus saja terjadi di laut Sulawesi. Ada beberapa faktor yang membuat hal tersebut terus terjadi, pertama, faktor lemahnya pengawasan yang dilakukan oleh aparat Indonesia serta meningkatnya kebutuhan akan pasokan ikan di dalam negeri Filipina dikarenakan adanya budaya makan ikan yang terus meningkat atau yang sering disebut dengan istilah over fishing. Meskipun demikian, Indonesia dan Filipina terus melakukan kerja sama dalam penegakan hukum dan pemberantasan kejahatan transnasionalisme di area laut Sulawesi dan laut Sulu.
