Abstract
Selling and purchasing agreements are considered since they have an agreement between seller and buyer regarding goods and prices. One good that can be an object for selling and purchasing is fuel oil, especially solar oil. Solar price is influenced by the prices of world oil and Presidential Regulation No. 191 of 2014. Oil and Gas Business Entities can determine solar's prices according to the market mechanism. Thus, solar's prices can change anytime, and solar's prices sold between Oil and Gas Business Entities can vary one from another. This study describes PT. Palma Satu, as a buyer, objected to paying the bill according to the agreement in the industrial solar oil buying contract to PT. Kim Mandiri Abadi as the seller. It is because they find a significant price gap with the purchasing bill of similar solar oil in another location. Thus, PT. Palma Satu feels injured if they have to pay the price gap and do not want to make a payment. The study aims to discover the judge's legal considerations in deciding the suit for default in the Supreme Court's decision No. 453 K/PDT/2019. The research methodology uses a normative juridical method with analytical descriptive research specifications. Based on the analysis results, it is concluded that the action of PT. Palma Satu, as a buyer, is regarded as a party that does not perform well. Thus, PT. Palma Satu is regarded as the party of default because solar price differences are found, and it can not be used as an excuse for PT. Palma Satu to not make a payment as agreed.
