Abstract

Restorative Justice is a legal settlement process with the principle of replacing the penal law by bringing together perpetrators and victims to creat conflict resolution through compensation efforts so that victims get justice and rights. The implementation of Restorative Justice can be carried out for cases of children or women who are facing the law, minor crimes to drug crimes for addicts or drug abusers. Restorative Justice against drug abusers or addicts that can be resolvedin the investigation or investigation stage is a manifestation of the Chief of Police Regulation Number 8 of 2021 on the Circular Letter Number 8 of 2018 issued by the Indonesian National Police . This study aims to determine the procedure for solving drug crime cases through Restorative Justice at Banyumas Police Resort and the obstacles faced in solving Restorative Justice. The research method usedis a sociological juridical approach with analytical descriptive research specifications. The types and sources of law in this study come from primary data and secondary data.The data obtained are then analyzed by qualitative analysis methods. Based on the resultsof the study, it was found that the implementation of Restorative Justice in Narcotics Crime has differences in the mechanism with that regulated in Circular Number 8 In 2018 there are certain conditions and special stages that are only found in cases of Drug Crimes and which are factors in solving through Restorative Justice comes from the factors of the law itself and society.
