Abstract
RINGKASAN ACHMAD HUSNUL KHULUQY, Program Studi Magister Ilmu Hukum, Program Pascasarjana, Universitas Jenderal Soedirman, “Kewenangan Badan Penyelesaian Sengketa Konsumen (BPSK) Dalam Memutus Sengketa Wanprestasi Pada Perjanjian Asuransi Kendaraan Bermotor (Studi Putusan PN No. 67/Pdt.Sus.BPSK/2016/PN Mdn dan Putusan MA No. 796 K/Pdt.Sus-BPSK/2016) Komisi Pembimbing, Ketua: Prof. Dr. Sulistyandari S.H., M.Hum. Anggota : Dr. Rahadi Wasi Bintoro S.H., M.H Badan Penyelesaian Sengketa Konsumen (BPSK) adalah lembaga yang bertugas menyelesaikan sengketa antara pelaku usaha dan konsumen di luar pengadilan. BPSK dibentuk berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Dalam salah satu kasus yang berkaitan dengan sengketa wanprestasi asuransi, salah satu putusannya, yaitu No. 736/PEN/BPSK-Mdn/2015 Tanggal 21 Januari 2016 menyatakan konsumen berhak atas pencairan klaim asuransi kendaraan bermotor, yang diperkuat melalui putusan Pengadilan Negeri Medan No. 67/Pdt.Sus.BPSK/2016/PN Mdn tanggal 4 April 2016, yang kemudian putusan tersebut dibatalkan dengan Putusan MA. Penelitian ini dilakukan dengan tujuan untuk menganalisa kewenangan BPSK dalam memutus sengketa wanprestasi pada perjanjian asuransi kendaraan bermotor serta kemungkinan adanya pelanggaran itikad baik yang melatarbelakangi terjadinya wanprestasi. Penelitian ini menggunakan metode penelitian yuridis normatif. Jenis data yang digunakan adalah data sekunder yang diperoleh melalui bahan hukum primer meliputi peraturan perundang-undangan dan putusan pengadilan, bahan hukum sekunder yang terutama adalah buku hukum, termasuk skripsi, tesis, dan disertasi hukum dan jurnal hukum, serta kamus hukum dan komentar atas putusan pengadilan, serta bahan hukum tersier yang diperoleh melalui studi kepustakaan. Berdasarkan hasil penelitian dan pembahasan, maka dapat disimpulkan bahwa Mahkamah Agung melalui Putusan No. 796 K/Pdt.Sus-BPSK/2016 dengan tegas membatalkan putusan BPSK, menyatakan bahwa BPSK tidak berwenang mengadili sengketa wanprestasi dalam perjanjian asuransi karena perkara tersebut berhubungan dengan sengketa hak dan kewajiban yang didasarkan pada perjanjian, dalam hal ini perjanjian asuransi yang berpotensi kepada wanprestasi yang secara absolut berada dalam kompetensi Pengadilan Negeri. Alasan penolakan klaim oleh perusahaan asuransi pada perkara putusan PN No. 67/Pdt.Sus.BPSK/2016/PN Mdn dan Putusan MA No. 796 K/Pdt.Sus-BPSK/2016 dilakukan dengan dasar adanya pelanggaran prinsip itikad baik oleh tertanggung, seperti penggunaan objek pertanggungan sebagaimana diatur dalam polis asuransi. Ketentuan Pasal 251 KUHD menjadi inkonstitusional bersyarat oleh putusan Mahkamah Konstitusi Nomor 83/PUU-XXII/2024 tanggal 20 Desember 2024 semakin memperkuat kedudukan konsumen dalam perjanjian yang mengandung klausul baku seperti perjanjian asuransi. Member: Dr. Rahadi Wasi Bintoro S.H., M.H. The Consumer Dispute Resolution Agency (BPSK) is an institution tasked with resolving disputes between business actors and consumers outside the court. BPSK was established based on Law Number 8 of 1999 concerning Consumer Protection. In one case related to an insurance default dispute, one of its decisions, namely No. 736/PEN/BPSK-Mdn/2015 dated January 21, 2016, stated that consumers have the right to disbursement of motor vehicle insurance claims, which was strengthened by the Medan District Court decision No. 67/Pdt.Sus.BPSK/2016/PN Mdn dated April 4, 2016, which was then annulled by the Supreme Court Decision No. 796 K/Pdt.Sus-BPSK/2016. This study was conducted with the aim of analyzing the authority of the Consumer Dispute Resolution Agency (BPSK) in deciding default disputes in motor vehicle insurance agreements and the possibility of a breach of good faith underlying the default. This study uses a normative legal research method. The types of data used are secondary data obtained through primary legal materials including legislation and court decisions, secondary legal materials, primarily law books, including legal theses, dissertations, and legal journals, as well as legal dictionaries and commentaries on court decisions, and tertiary legal materials obtained through library research. Based on the research and discussion, the following conclusions can be drawn: The Supreme Court, through Decision No. 796 K/Pdt.Sus-BPSK/2016, firmly overturned the BPSK decision, stating that the BPSK lacked the authority to adjudicate on a breach of contract dispute in an insurance agreement because the case concerned a dispute over rights and obligations based on the agreement, in this case an insurance agreement with the potential for breach, which is absolutely within the jurisdiction of the District Court. The insurance company's claim rejection in District Court Decision No. 67/Pdt.Sus.BPSK/2016/PN Mdn and Supreme Court Decision No. 796 K/Pdt.Sus-BPSK/2016 was based on a breach of the principle of good faith by the insured, such as the use of the insured object as stipulated in the insurance policy. The provisions of Article 251 of the Commercial Code were declared conditionally unconstitutional by the Constitutional Court's decision Number 83/PUU-XXII/2024 dated December 20, 2024, further strengthening the position of consumers in agreements containing standard clauses such as insurance agreements.
