Abstract

Law Number 8 of 1999 concerning Consumer Protection is expected to guarantee the achievement of protection for consumers in Indonesia. The widespread circulation of 12 Kg LPG gas cylinders that are not in accordance with the filling carried out by business actors with the aim of taking the maximum profit often results in losses for consumers. In this case, the author is interested in examining how the legal protection for consumers of gas fuel or liquefied petroleum gas (LPG) is based on Law Number 8 of 1999 concerning Consumer Protection in Decision Number 586/Pid.Sus/2021/PN-DPS. The approach method used is a normative juridical approach. The data used is secondary data in the form of court decisions, literature books, laws and regulations, official documents and internet sites by means of literature study, namely an inventory of these data which is then presented in the form of a systematic description. The method of analyzing legal materials is by using a qualitative normative analysis method. Based on the results of research and discussion, the judge in deciding the case has provided legal protection to consumers because the judge uses Article 40 point 9 of Law Number 11 of 2020 concerning Job Creation. The judge stated in the District Court Decision Number 586/Pid.Sus/2021/PN-DPS that Abdul Latif Efendi as a business actor was legally and convincingly proven guilty of committing the Criminal Acts of Misuse of Commercial Fuel Oil, Gas Fuel or LPG, and had sentenced him with imprisonment of 1 year and a fine of 1 billion rupiah, provided that if the fine is not paid, it is replaced with 3 months in prison and charged with court fees of Rp. 2000, - (two thousand rupiah). In addition, consumers get legal protection as regulated in Article 7 letters (a), (b), (d), and (f), Article 4 letters (a) and (c), as well as Article 8 paragraph (1) letter ( a), (b), (c), (d) and (e) in conjunction with Article 62 paragraph (1) of Law Number 8 of 1999 concerning Consumer Protection.
