Abstract

ABSTRAK EFEKTIVITAS PENYELESAIAN SENGKETA MEDIK DENGAN CARA MEDIASI PADA KLINIK KECANTIKAN DI WILAYAH DINAS KESEHATAN KABUPATEN BANYUMAS Betty Agung Purwaningrum Efektivitas hukum penyelesaian sengketa medik dapat diukur maka kita juga harus tahu sejauh mana hukum itu ditaati atau tidak.Namun sebenarnya ditaati atau tidaknya suatu hukum tergantung kepada kepentingan seseorang dan kepentingan tersebut bersifat macam-macam.Dalam penyelesaian sengketa dapat digunakan dua jalur yaitu (peradilan) litigasi dan non litigasi/konsensual/ non ajudikasi. Berdasarkan hal tersebut untuk menyelesaiakan sengketa adalah salah satunya dengan cara mediasi. Mediasi adalah cara penyelesaian masalah sengketa medik melalui proses perundingan untuk memperoleh kesepakatan para pihak dibantu dengan mediator mediasi itu sendiri. Pengukuran efektivitas hukum yang antara lain menyatakan bahwa tujuan dari norma hukum adalah dapat mencerminkan politik hukum dari pembuat perundang-undangan. Adanya kasus sengketa medik pada klinik kecantikan di wilayah Dinas Kesehatan Kabupaten Banyumas yang menjadi dasar penelitian. Penelitian dititik beratkan untuk mengetahui apakah penyelesaian sengketa medik dengan cara mediasi sudah efektif dan kendala yang dihadapi dalam rangka penyelesaian sengketa medik. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan secara yuridis empiris. Penelitian yuridis empiris merupakan salah satu jenis penelitian hukum yang menganalisis dan mengkaji bekerjanya hukum di dalam masyarakat. Berdasarkan hasil penelitian maka di dapatkan hasil efektivitas penyelesaian sengketa medik dengan cara mediasi pada klinik kecantikan di wilayah Dinas Kesehatan Kabupaten Banyumas dengan cara mediasi adalah belum efektif, yaitu karena proses penyelesaian sengketa medik dengan cara mediasi dengan tujuan win - win solution belum tercapai antara dokter dengan pasien. Proses mediasi yang dilakukan oleh Dinas Kesehatan Kabupaten Banyumas belum sesuai dengan ketentuan yang berlaku. Kendala kendala yang dihadapi dalam rangka penyelesaian sengketa medik adalah Substansi hukum Dinas Kesehatan Kabupaten Banyumas dan dokter penanggung jawab klinik belum mengetahui peraturan perundangan yang dibuat secara khusus untuk mengatur tentang klinik kecantikan. Struktur hukum Dinas Kesehatan Kabupaten Banyumas tidak mengetahui tentang proses mediasi yang sesuai dengan peraturan perundang- undangan yang berlaku. Budaya hukum Masyarakat belum tahu hak dan kewajiban apabila terjadi sengketa medik. Kata kunci : Efektivitas sengketa medik,mediasi, klinik kecantikan ABSTRACT THE EFFECTIVENESS OF MEDICAL DISPUTE THROUGH MEDIATION AT THE BEAUTY CLINIC IN THE HEALTH SERVICE AREA OF BANYUMAS DISTRICT The effectiveness of that law is measurable, so we must also know the extent to which it obeyed. But the compliance or failure of a law depends on one's interests and those interests are varied. In dispute settlement you can use two pathways: litigation and non-consensual judiciary. Based on these issues for settling disputes is one of them through mediation. Mediation is the solution of the medical dispute through a negotiating process to obtain agreement for the parties by the mediation medium itself. Measuring the effectiveness of laws in part states that the purpose of law norms can reflect the political laws of legislation. There is medical dispute over the beauty clinic of the banyumas districk health service that is the basis for research. Research aims to find out whether the medical approach with mediation is effective and obtracle faced in the treatment of medical disputes. The approach method used in this study is a juridical empirical approach. Empirical juridical research is one type of legal study that analyzes and examines the workings of laws in communities. According to the study, the results of the effectiveness of medical issues resulting from mediation at the beauty clinic in the region of banyumas district's health care care care are not as effective that is because the medical solution with the mediation goal to win win solution has not been reached between physicians and patien. The process of mediating the health services of banyumas district was not yet regulated. The obstacles encountered n the medical dispute are legal subtances. The health services of Banyumas and the medical director of the clinic are not yet aware of the invistation laws specifically made to manage beauty clinic. The legal structure is that the health services of Banyumas district are unawere of the mediation process that conforms to the current regulatory legislation. A legal culture in which people do not know the right and obligation if medical issues arise. Key words: the effectiveness of medical, mediation, beauty clinics
