Abstract

Prisoners have rights and obligations that have been regulated in Law No. 22 of 2022 concerning Corrections. One of the rights obtained by prisoners who have met special requirements is assimilation. Assimilation is a coaching process carried out to prisoners by integrating prisoners into community life with the aim that the prisoners get skills and provisions after their criminal period is completed. Assimilation of prisoners is not only carried out in the Indonesian Penitentiary, but countries such as the United States have assimilation guidance for prisoners. The purpose of this research is to find out the implementation and obstacles of assimilation in accordance with Law No. 22 of 2022 concerning Corrections, and to find out the comparative results of assimilation in Indonesia and the United States. This research uses a juridical sociological approach with research specifications in the form of analytical descriptive supported by the type and source of data in the form of Primary Data and Secondary Data. The data collection method is in the form of interview results which are analyzed qualitatively and presented narratively. The results of the research are in the form of the implementation of Assimilation which is carried out in accordance with the regulated substance, but there are obstacles in terms of law enforcement and culture, and there are several differences that arise from the comparison between Indonesia and the United States, starting in terms of substance, structure, and culture itself.
