Abstract
Restorative Justice can be an effective way to solve persecution problems with the aim that legal problems caused by criminal acts by the perpetrator can be resolved outside the court fairly with the consent of all parties involved, namely the victim, the perpetrator, and the community. This study aims to determine the mechanism for implementing restorative justice in Decision Number 122/Pid.B/2021/PN Pbg and to find out the basis for the judge's legal considerations in imposing punishment on perpetrators of persecution in Decision Number 122/Pid.B/2021/PN Pbg by using a normative juridical approach method with prescriptive research specifications. The results of this study indicate that the mechanism for implementing restorative justice in Decision Number 122/Pid.B/2021/PN Pbg has fulfilled the requirements as stipulated in Article 5 (1) of Prosecutor's Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice. The Panel of Judges in imposing a sentence in Decision Number 122/Pid.B/2021/PN Pbg is based on the fulfillment of the conditions for punishment and evidence, as well as mitigating and aggravating circumstances. The Purbalingga District Attorney's Office is expected to prioritize restorative justice efforts for cases that meet certain criteria, so that the goal of sentencing, which includes restoring the victim to their original state and making punishment a last resort, can be achieved.
