Abstract
Law enforcement officers are indicated to still lack a gender perspective and exhibit gender bias in judicial practices. Judges are expected to uphold justice by possessing an understanding of and empathy toward gender perspectives or gender justice in legal proceedings. Therefore, this study aims to examine the implementation of the guidelines for adjudicating women in conflict with the law in realizing gender justice, as well as the factors that tend to influence such implementation at the Purwokerto District Court.This research employs a socio-juridical research method. The data used in this study consist of primary and secondary data, collected through interviews and literature review. The results of the study indicate that the implementation of the guidelines for adjudicating women in conflict with the law by judges at the Purwokerto District Court has been carried out properly. However, several obstacles remain in its implementation. This can be observed through the following parameters: judges have applied the principles contained in Supreme Court Regulation (Perma) No. 3 of 2017 concerning Guidelines for Adjudicating Cases Involving Women in Conflict with the Law to realize gender justice; judicial considerations have been based on gender equality and non-discrimination in achieving gender justice; the majority of judges have adhered to ethical standards in examining cases, although in practice this is still limited to judges who possess different levels of understanding and application in realizing gender justice; judges have provided rights, facilities, and support to women in conflict with the law to ensure the realization of gender justice. The supporting factors for implementation include: training for judges, cooperation with other institutions (such as the Judicial Commission), coordination with prosecutors and legal companions, judges' self-awareness as role models, and judicial independence in applying the regulation during trial proceedings. Inhibiting factors include: the presence of judges who hold differing views or behavioral approaches, disruptions to court proceedings by community organizations, and defendants' unwillingness to be accompanied by legal counsel.
