Abstract
RINGKASAN MURDIYANTI, Program Magister Kenotariatan Fakultas Hukum, Universitas Jenderal Soedirman, Perlindungan Hukum Bagi Pemberi Kuasa Dalam Akta Kuasa Jual Yang Dibuat Notaris, Komisi Pembimbing, Ketua Prof. Tri Listiani Prihatinah, S.H., M.A., Ph.D dan anggota Dr. Sulistyandari, S.H., M.Hum. Bank pada umumnya menyarankan debitur yang wanprestasi untuk membuat akta kuasa jual yang disertai akta kuasa lainnya yang isinya tentang pelunasan kredit dan pengambilan sertifikat di bank. Fungsi akta kuasa jual seharusnya untuk memberikan perlindungan atau kepastian hukum kepada pembeli yang sudah membayar lunas akan tetapi belum bisa melakukan proses balik nama di sertifikat tersebut karena masih terdapat syarat yang belum terpenuhi. Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi pemberi kuasa dalam akta kuasa jual yang dibuat Notaris tidak terdapat laporan dan perhitungan penutupan dari penerima kuasa kepada pemberi kuasa dan untuk menganalisis keabsahan klausul mengalihkan dalam bentuk apapun atas objek berupa tanah dan bangunan dalam akta kuasa jual dan akibat hukumnya. Metode pendekatan yang digunakan adalah yuridis normatif dengan menganalisis bahan hukum secara menyeluruh baik bahan hukum primer maupun bahan hukum sekunder. Hasil penelitian akta kuasa jual Notaris tidak terdapat laporan dan perhitungan penutupan dari penerima kuasa kepada pemberi kuasa tidak memberikan perlindungan hukum bagi pemberi kuasa karena akta kuasa jual tersebut batal demi hukum. Akta kuasa jual tersebut bertentangan dengan Pasal 20 ayat (4) Undang-Undang Hak Tanggungan yang mengatur bahwa apabila terjadi wanprestasi objek Hak Tanggungan harus diselesaikan dengan cara parate eksekusi, titel eksekutorial atau atas kesepakatan bersama penjualan bawah tangan untuk mendapatkan harga tertinggi, selain ketiganya maka batal demi hukum. Pemberi kuasa dengan tidak dilaksanakan penyelesaikan melalui ketiga cara tersebut tetap mendapat perlindungan hukum dari Pasal 1365 Kitab UndangUndang Hukum Perdata berupa hak menuntut perbuatan melawan hukum yang dilakukan penerima kuasa, bank dan Notaris. Selain itu ditemukan juga dalam penelitian ini bahwa keabsahan klausul mengalihkan dalam bentuk apapun atas objek berupa tanah dan bangungan dalam akta kuasa jual tersebut tidak sah, klausul tersebut bertentangan dengan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah Pasal 39 Ayat (1) huruf d yang mengatur tentang larangan penggunaan kuasa mutlak yang pada hakekatnya berisikan perbuatan hukum pemindahan hak atas tanah, akibat hukumnya klausul tersebut batal demi hukum. Advisor Commission, Chairperson Prof Tri Listiani Prihatinah, S.H., M.A., Ph.D. and members Dr. Sulistyandari, S.H., M.Hum. Banks generally advise debtors who are in default to make a power of attorney to sell along with other power of attorney which contains credit repayment and collateral withdrawal at the bank. The function of the power of attorney to sell should be to provide protection or legal certainty to buyers who have paid in full. This study aims to analyze the legal protection of people who provide power of attorney in a power of attorney made by a notary, there is no report and calculation of the closure of the person who is authorized and to analyze the validity of the transfer clause in any form over objects in the form of land and buildings in the power of attorney to sell and its legal consequences. The approach method used is normative juridical by thoroughly analyzing legal materials, both primary and secondary legal materials. The results of the research on the power of attorney to sell notary there are no reports and the calculation of the closure of the person who is given the power of attorney to the power of attorney does not provide legal protection for the power of attorney because the power of attorney to sell is null and void. The power of attorney to sell is contrary to Article 20 paragraph (4) of the Mortgage Rights Law which stipulates that in case of default, the object of the Mortgage must be resolved through an auction, has permanent legal force, or under joint sales agreement underhand to get the highest price, apart from the three then it is null and void. the person who gives the power of attorney without being resolved through these three methods will still receive legal protection from Article 1365 of the Civil Code in the form of the right to sue for unlawful acts committed by the person receiving the power of attorney, the bank and the notary public. Besides, it is also found in this study that the validity of the transfer clause in any form of objects in the form of land and buildings in the power of sale is invalid. This clause contradicts Government Regulation Number 24 of 1997 concerning Land Registration, Article 39 Paragraph (1) letter d, which regulates the prohibition on the use of absolute power which essentially contains legal actions of transfer of rights to land, as a result of which the clause is null and void by law.
